Eligibility overview
Who can make a VW Dieselgate claim?
You may be eligible if you owned or leased (new or used) a diesel VW, Audi, SEAT, or Škoda vehicle with an EA189 or EA288 engine between 2009 and 2020. The vehicle must have been fitted with defeat device software — VW has published a VIN checker confirming affected vehicles. You do not need to still own the vehicle. The claim is for mis-selling — you were sold a car with falsified emissions data.

FAQs
VW Dieselgate UK claim — questions answered
My VW received a software update recall — does that affect my claim?+
No — accepting a recall update or fix does not waive your right to compensation for the original mis-selling. The recall addressed the mechanical defect but did not compensate you for having been sold a vehicle with falsified emissions data. The claim is about mis-selling at the point of purchase, not about the ongoing performance of the vehicle.
I bought my VW from a private seller — can I still claim against VW?+
Purchasing a used VW through a private sale is more complex. Your primary claim would typically be against the original selling dealer (who has a direct liability to the first purchaser) or against VW Group directly (as manufacturer of the defective vehicle). Specialist solicitors handle used car Dieselgate claims — the analysis depends on the purchase price you paid and whether you relied on the false emissions data in making your decision.
How do I confirm my VW is affected by the defeat device?+
VW Group published a VIN-based lookup tool at vwgrouprecall.co.uk. Enter your vehicle's VIN (on the dashboard at the base of the windscreen, or in your V5C logbook) to confirm whether it is in the affected batch. Your solicitor can also confirm this using the VIN through the litigation's vehicle data. EA189 engine vehicles (1.6 TDI and 2.0 TDI, 2009–2015) are almost universally confirmed as affected.
